一開始標明的是雇員的個人信息,如姓名、家庭地址等等。

然后,正文主題一般就是寒暄話,恭喜你獲得該職位等等,除了恭喜之外,有時候還有一些附件條件,比如下面這段話:

It is my pleasure to extend the following offer of employment to you on behalf of (your company name). This offer is contingent upon your passing our mandatory drug screen, our receipt of your college transcripts, and (any other contingencies you may wish to state).
很高興代表XXX公司給你發(fā)這份聘書。只有您通過強制性的毒品濫用篩檢,我方收到您的大學成績單(及其他附件條件),此份聘書才正式生效。

1.Title
工作頭銜
這邊會清楚寫明雇員的工作職位、頭銜,以及直屬上司等信息,如下:
Your title will be customer support specialist if you accept this employment offer. You will report to Steve Smith, manager of customer support.
如果你接受這份聘書,你的頭銜將是客戶支持專員。 你將向客戶支持經(jīng)理Steve Smith報告。

2.Job Description

一般來說,你需要確保工作職責描述準確無誤,以防之后老板會改變你的工作內(nèi)容,會以其他方式給你降級,所以工作描述要準確。

In the role of customer support specialist, you will be expected to carry out the duties and responsibilities described in the enclosed job description which is periodically updated to reflect customer service needs.
客服支持專員的職責是:執(zhí)行附件中工作崗位說明書中的職責,履行相關義務。此項崗位說明將會不定期更新,以更好地反映客戶服務需求。

3.Dates and Times
工作開始日期
通常開說,offer letter里會標明正式上班日期,但如果你需有休假計劃,或者需要搬家,也可以要求上班日期往后延期。此外,如下一些注意事項也非常重要。

You are expected to start your employment on August 1st, 2017. Please report to the customer service department where you will begin your onboarding process at 9:00 a.m.

4.Base Salary

5.Benefits/Bonuses
福利/獎金
每個公司,獎金/福利如何計算,有時候確實難復雜,所以要確保到手的獎金數(shù)額。

同時,你需要注意有些公司用那種模棱兩可的話語來描述獎金體系,所以你也要留心。

你至少需要知道百分比,時間(年薪、月薪),標準,是自由決定的(discretionary),還是固定不變的( guaranteed)。

各個公司,有不同的福利,比如免費午餐,寵物醫(yī)保等,每個公司不一樣,但有幾個關鍵的福利你需要注意。

6.Confidentiality and Non-Disclosure clause

不公開和保密協(xié)議(confidentiality and non-disclosure clause)是offer letter重要部分。

通常保密協(xié)議規(guī)定了在任職期間,你必須保密的信息,以及破壞保密協(xié)議,可能面臨的后果,比如訴訟等等(sensitive information that you learn in your tenure at a company private, or else face consequences such as lawsuits)。

保密協(xié)議可能包括財務報告、通訊消息、產(chǎn)品設計或者其他內(nèi)部物品。
Non-disclosure Agreement: You acknowledge that during your employment with the Employer, confidential information will be disclosed to you and, any unauthorized revelation of such information to any individual or party or for use other than for the Employer’s purposes could cause wide harm to the Employer. The confidential information of the Employer includes any and all trade secrets, private or secret information of the Employer (includes, but does not limit to)
你清楚,在合同期內(nèi),你會接觸到機密信息,任何未經(jīng)授權(quán)向他人或第三方披露機密信息,將對雇主造成嚴重傷害。機密信息包括但不限于雇主的所有商業(yè)秘密,私人或秘密信息。

7.Non-Compete Clause
不競爭條款
不競爭條款是雇主和雇員之間簽訂的合同,這個條款規(guī)定了雇員在一段時間內(nèi),不能去和雇主有競爭關系的公司工作,以防止競爭。

如果雇員要找新工作,就需要等不競爭條款失效過期,或者搬去其他地方,或者換個行當(have to wait for the agreement to lapse, move to another geographic area, or change industries)。
?
所以,不競爭條款對雇員職業(yè)生涯影響還是挺大的,所以如果offer letter里有這樣的條款,你一定要想清楚再簽訂。

You covenant and agree that, during the term of your employment with the Company and for twelve (12) months after the termination thereof, regardless of the reason for the employment termination, you will not, directly or indirectly, anywhere in the Territory, on behalf of any Competitive Business perform the same or substantially the same Job Duties.

另外,有些公司還有 Non-Solicit clause(禁止招徠條款)

和上面的不競爭條款有些類似,但也有區(qū)別,禁止招徠條款指的是雇員離職后不得拉攏原公司的人員或者把原公司的客戶、關系帶走,不能損害原雇主的利益。

8.At-Will clause
自由雇傭原則
自由雇傭原則意味著雇主在任何時期,可以有理由或者無理由地和員工解除勞務關系,歧視、報復、其他特殊情況除外(barring cases of discrimination, retaliation, and other special circumstances)。?

這可能聽起來有點令人震驚,但并不意味著公司能夠隨便裁掉員工(go around firing people on a whim)。

另一面,這項條款也意味著雇員也能夠隨時提出辭職。

You acknowledge and agree that nothing in this Agreement is a guarantee or assurance of employment for any specific period of time. Rather, you understand that you are an at-will employee and that the Company may terminate your employment at any time for any reason. You are similarly free to resign at any time for any reason.

9.Arbitration Clauses
仲裁條款
最后一項棘手條款是仲裁條款。條款一般規(guī)定雇員和雇主之間若發(fā)生任何爭議,必須由中立的第三方解決,這項條款可能讓你遇到一些法律上頭疼的問題。
(The final tricky provisions to look out for are arbitration clauses, which state that any disputes that arise between an employee and an employer must be settled by a neutral third party)

雇主肯能偷偷把這條加入offer letter中,而一旦你將來要和雇主法庭相見,可能給你帶來很多麻煩事。所以要保護好自己,至少你要知道在offer letter里有這樣一條條款。
