一開(kāi)始標(biāo)明的是雇員的個(gè)人信息,如姓名、家庭地址等等。

然后,正文主題一般就是寒暄話,恭喜你獲得該職位等等,除了恭喜之外,有時(shí)候還有一些附件條件,比如下面這段話:

It is my pleasure to extend the following offer of employment to you on behalf of (your company name). This offer is contingent upon your passing our mandatory drug screen, our receipt of your college transcripts, and (any other contingencies you may wish to state).
很高興代表XXX公司給你發(fā)這份聘書。只有您通過(guò)強(qiáng)制性的毒品濫用篩檢,我方收到您的大學(xué)成績(jī)單(及其他附件條件),此份聘書才正式生效。

1.Title
工作頭銜
這邊會(huì)清楚寫明雇員的工作職位、頭銜,以及直屬上司等信息,如下:
Your title will be customer support specialist if you accept this employment offer. You will report to Steve Smith, manager of customer support.
如果你接受這份聘書,你的頭銜將是客戶支持專員。 你將向客戶支持經(jīng)理Steve Smith報(bào)告。

2.Job Description

一般來(lái)說(shuō),你需要確保工作職責(zé)描述準(zhǔn)確無(wú)誤,以防之后老板會(huì)改變你的工作內(nèi)容,會(huì)以其他方式給你降級(jí),所以工作描述要準(zhǔn)確。

In the role of customer support specialist, you will be expected to carry out the duties and responsibilities described in the enclosed job description which is periodically updated to reflect customer service needs.

3.Dates and Times
工作開(kāi)始日期
通常開(kāi)說(shuō),offer letter里會(huì)標(biāo)明正式上班日期,但如果你需有休假計(jì)劃,或者需要搬家,也可以要求上班日期往后延期。此外,如下一些注意事項(xiàng)也非常重要。

4.Base Salary

5.Benefits/Bonuses

每個(gè)公司,獎(jiǎng)金/福利如何計(jì)算,有時(shí)候確實(shí)難復(fù)雜,所以要確保到手的獎(jiǎng)金數(shù)額。

同時(shí),你需要注意有些公司用那種模棱兩可的話語(yǔ)來(lái)描述獎(jiǎng)金體系,所以你也要留心。

你至少需要知道百分比,時(shí)間(年薪、月薪),標(biāo)準(zhǔn),是自由決定的(discretionary),還是固定不變的( guaranteed)。

通常保密協(xié)議規(guī)定了在任職期間,你必須保密的信息,以及破壞保密協(xié)議,可能面臨的后果,比如訴訟等等(sensitive information that you learn in your tenure at a company private, or else face consequences such as lawsuits)。

Non-disclosure Agreement: You acknowledge that during your employment with the Employer, confidential information will be disclosed to you and, any unauthorized revelation of such information to any individual or party or for use other than for the Employer’s purposes could cause wide harm to the Employer. The confidential information of the Employer includes any and all trade secrets, private or secret information of the Employer (includes, but does not limit to)

7.Non-Compete Clause
不競(jìng)爭(zhēng)條款
不競(jìng)爭(zhēng)條款是雇主和雇員之間簽訂的合同,這個(gè)條款規(guī)定了雇員在一段時(shí)間內(nèi),不能去和雇主有競(jìng)爭(zhēng)關(guān)系的公司工作,以防止競(jìng)爭(zhēng)。

如果雇員要找新工作,就需要等不競(jìng)爭(zhēng)條款失效過(guò)期,或者搬去其他地方,或者換個(gè)行當(dāng)(have to wait for the agreement to lapse, move to another geographic area, or change industries)。

所以,不競(jìng)爭(zhēng)條款對(duì)雇員職業(yè)生涯影響還是挺大的,所以如果offer letter里有這樣的條款,你一定要想清楚再簽訂。

You covenant and agree that, during the term of your employment with the Company and for twelve (12) months after the termination thereof, regardless of the reason for the employment termination, you will not, directly or indirectly, anywhere in the Territory, on behalf of any Competitive Business perform the same or substantially the same Job Duties.

和上面的不競(jìng)爭(zhēng)條款有些類似,但也有區(qū)別,禁止招徠條款指的是雇員離職后不得拉攏原公司的人員或者把原公司的客戶、關(guān)系帶走,不能損害原雇主的利益。

You also covenant and agree that during the term of your employment with the Company and for twelve (12) months after the termination thereof, regardless of the reason for the employment termination, you will not, directly or indirectly, solicit or attempt to solicit any business from any of the Company’s Customers, Customer Prospects, or Vendors with whom you had Material Contact during the last two (2) years of your employment with the Company.

8.At-Will clause
自由雇傭原則
自由雇傭原則意味著雇主在任何時(shí)期,可以有理由或者無(wú)理由地和員工解除勞務(wù)關(guān)系,歧視、報(bào)復(fù)、其他特殊情況除外(barring cases of discrimination, retaliation, and other special circumstances)。?

這可能聽(tīng)起來(lái)有點(diǎn)令人震驚,但并不意味著公司能夠隨便裁掉員工(go around firing people on a whim)。

另一面,這項(xiàng)條款也意味著雇員也能夠隨時(shí)提出辭職。

You acknowledge and agree that nothing in this Agreement is a guarantee or assurance of employment for any specific period of time. Rather, you understand that you are an at-will employee and that the Company may terminate your employment at any time for any reason. You are similarly free to resign at any time for any reason.

9.Arbitration Clauses
仲裁條款
最后一項(xiàng)棘手條款是仲裁條款。條款一般規(guī)定雇員和雇主之間若發(fā)生任何爭(zhēng)議,必須由中立的第三方解決,這項(xiàng)條款可能讓你遇到一些法律上頭疼的問(wèn)題。

雇主肯能偷偷把這條加入offer letter中,而一旦你將來(lái)要和雇主法庭相見(jiàn),可能給你帶來(lái)很多麻煩事。所以要保護(hù)好自己,至少你要知道在offer letter里有這樣一條條款。
